The petitioner seeks bail in connection with Rail Jehanabad (Tarengna) G.R.P. Case No. 12 of 2018 registered for the offences punishable under Sections 379/34 of the Indian Penal Code.

Allegedly, gold Mangle sutra of the sister of the informant was taken away and the miscreants started fleeing away but after chase the petitioner was caught. Submission is of false implication and that nothing has been recovered from possession of the petitioner, without any fault the petitioner is suffering in custody since 27.02.2018 having no criminal antecedent, chargesheet has already been submitted and there is no chance of tampering with prosecution

Learned A.P.P. fairly submits that the crime was committed in the train.

In the facts and circumstances stated above, the petitioner is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Learned Additional Chief Judicial Magistrate Railway, Patna, in connection with Rail Jehanabad (Tarengna) G.R.P. Case No. 12 of 2018 (G.R. No. 63 of 2018), subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
