2. The petitioner seeks regular bail in connection with Shekhopur Sarai P.S. Case No. 11 of 2018, POCSO Case No. 14 of 2021, registered for the offence under Sections 354/354D, 509 of the Indian Penal Code and section 8 of the POCSO Act and section 3(2)(Va), 3(r) (S) (w) (II) of the SC/ST Act.
3. In a case of misuse of privilege of bail, the petitioner is in custody since 05.08.2024.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner has clean antecedent.
5. Learned A.P.P. has vehemently opposed the prayer
Patna High Court CR. MISC. No.75077 of 2024(2) dt.23-10-2024 2/2 for bail.
6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.
7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional District & Session Judge cum Exclusive Special Judge (POCSO), Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 11 of 2018, POCSO Case No. 14 of 2021, subject to the condition that the petitioner will cooperate in the trial. He will appear regularly personally or through his lawyer. Any violation of the undertaking given by learned counsel for the petitioner would result in the cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) Ranjeet/- U T
