JUSTICE ARUN KUMAR ORAL ORDER 05-07-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Beaur P.S.Case No. 324 of 2017 registered under Sections 323,379,420,504 and 506 of the Indian penal Code.

Allegation in brief is that petitioner took loan of Rs. 7,35,000/- from the informant for purchasing a piece of land and promised to return back but money was not returned and only Rs. 4 lakhs was returned by his father.

Submission is that petitioner undertakes to return back remaining amount of Rs. 3,00,000/- as he had taken that much amount as loan and would be able to pay back in installment only after one month of his release subsequently every month by depositing demand draft of Rs. 50,000/- per month in favour of the informant in six installments.

No.34341 of 2018(2) dt.05-07-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely, Sanjay Kumar Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Judge VIII, Patna in connection with Beur P.S. Case No. 324 of 2017 with condition that he shall pay, as per undertaking, Rs. 3,00,000/- in six installments to the informant by demand draft and the first installment will be paid after one month of his release and remaining amount subsequently in five equal installment in succeeding months. In case of default in payment, petitioner's bail bond shall be liable to be cancelled. (Arun Kumar, J) sujit/- U T
