JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-07-2018 This application for grant of regular bail arises out of Bagaha (Bhairoganj) P.S. Case No. 147 of 2017 (Sessions Trial No. 83 of 2018), dated 20.03.2017, instituted for the offence under Sections 302/34 of the Indian Penal Code.
The husband of the informant went missing. On search, his dead-body was found in a room. In course of investigation, it came to light that the deceased had developed illicit relationship with the petitioner. The
Patna High Court Cr.Misc. No.34069 of 2018 (3) dt.06-07-2018 2/2 petitioner was also carrying on an affair with one Ghura Mukhiya. On the day of the occurrence, Ghura Mukhiya saw the petitioner in a compromising position with the deceased and, thereafter, the deceased was done to death by aforesaid Ghura Mukhiya. The aforesaid fact has come to the fore only on the confession of aforesaid Ghura Mukhiya Learned counsel for the petitioner has further submitted that aforesaid Ghura Mukhiya has been granted bail by a Bench of this Court vide order dated 18.05.2018, passed in Cr. Misc. No. 23530 of 2018.
The petitioner is in custody since 23.03.2017. Regard being had to the aforesaid facts, the petitioner, above named, is directed to be released on bail on her furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Bagaha, West Champaran in connection with Sessions Trial No. 83 of 2018, arising out of Bagaha (Bhairoganj) P.S. Case No. 147 of 2017.
