====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-11-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Harsiddhi P. S. Case No. 372 of 2025 in a case registered for the offences punishable under Sections 115(2), 117(2), 118(2), 126(2), 109(1), 103(1), 351, 352, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., all the named accused persons assaulted the husband of informant by various deadly weapons as a result of which, he succumbed to injuries.

4. Learned counsel for the petitioners submits that from bare perusal of the F.I.R., it is apparent that petitioners are not assailants of the deceased and they are only alleged to have assaulted brother-in-law of the informant who sustained grievous injuries. Case and counter case. Petitioners are in custody since 11.06.2025. Charge-sheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Motihari in connection with Harsiddhi P. S. Case No. 372 of 2025.
