The petitioner, in the present case, is seeking regular bail in connection with Bachhwara P.S. Case No. 12 of 2011, registered for offences alleged under Sections 399, 402 and 414 of Indian Penal Code and Sections 25(1-B)A 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that the name of the petitioner has transpired on the statement of the co-accused who alleged that this petitioner was one of the persons who had fled away on seeing the police party. It is submitted that the police party raided the house of Rajan Paswan from where two Nokia Mobiles and six Apache motorcycles were recovered. It is submitted that one more case is on the head of petitioner in which
Patna High Court Cr.Misc. No.34201 of 2018 (2) dt.14-06-2018 he is on bail. It is further submitted that no recovery has been made from the house or the possession of the petitioner. Learned APP for the State is present.
Considering the facts and circumstance of the case whereunder it is stated that there is no recovery from the possession of the petitioner and his name has come on the statement of the co-accused, let the petitioner above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned F.T.C. 1st , Begusarai in connection with S.T. No. 183/2018 arising out of Bachhwara P.S. Case No. 12 of 2011, subject to the conditions U/S 437(3) Cr.P.C. (Rajeev Ranjan Prasad, J) Arvind/- U T
