Ms.Rina Sinha ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-11-2025 Heard learned counsel for the petitioners and learned A.P.P for the State.

2. The petitioners seek bail in a case registered for the offence punishable under Sections 115(2), 117(2), 118(2), 126(2), 109(1), 103(1), 351, 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the FIR, these two petitioners assaulted on the scrotum of the deceased (husband of the informant) with Muari.

4. Learned counsel for the petitioners submits that petitioners have been falsely implicated due to land dispute.

Patna High Court CR. MISC. No.67904 of 2025(3) dt.12-11-2025 2/2 Petitioners claim clean antecedent. Petitioner no. 1 is in custody since 11.06.2025 and petitioner no. 2 is in custody since 16.06.2025.

5. Learned APP however, vehemently opposes the prayer for bail and submits that postmortem reports supports the prosecution case. Petitioners are assailants of the deceased

6. Considering the facts aforesaid and nature of accusation, I am not inclined to enlarge the petitioners abovenamed on bail in connection with Harsiddhi PS Case No. 372 of 2025, pending in the Court of learned Judicial Magistrate Is Class, Motihari. Accordingly, the same is rejected.

7. However, as petitioner no. 1 is in custody since 11.06.2025 and petitioner no. 2 is in custody since 16.06.2025, the trial Court is directed to expedite and conclude the trial preferably within a period of one year from the date of receipt/production of a copy of this order.
