Petitioner seeks bail in a case registered for the offence punishable under Sections 30(a) and 56(d) of the Bihar Prohibition and Excise Act, 2016.

4500 litres of foreign liquor is said to have been recovered from the truck abandoned in the parking slot of the Bhabhua railway station.

It is submitted by learned counsel for the petitioner that the petitioner happens to be mere driver of the aforesaid truck. Aforesaid liquor was got loaded on the truck by its owner namely Raushan Kumar Yadav for transporting it from Delhi to Howrah against the valid documents, but as the said truck and the

No.34009 of 2018 (2) dt.20-06-2018 2/2 liquor loaded on it were not got entered in the check post of the Excise department located on the boarder of the State of Bihar and also not digitally locked, the said truck and the liquor loaded on it were apprehended by the police. Aforesaid fact also found mentioned in the written report. Owner of the truck has been enlarged on bail by the learned lower court. Petitioner was not apprehended on the spot. He has no criminal antecedent. He has been languishing in custody since 30.04.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Sasaram (Bhabhua) Rail P.S. Case No. 119 of 2017.
