The petitioner seeks bail in a case initially registered under Sections-498A, 307/34 of the Indian Penal Code in which later on, Section-304B of the Indian Penal Code was also added. Allegation against the petitioner is of committing torture and causing death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18-04-2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses against the petitioner. The petitioner is married Nanad of the deceased. She is separate in mess and property from husband of

Patna High Court Cr.Misc. No.36253 of 2018 (3) dt.20-07-2018 the deceased. The main allegation is against husband of the deceased.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Bhagalpur in connection with Akbarnagar P.S. Case No. 34 of 2018.
