2. The petitioners seek bail in connection with Phulwariya P.S. Case No. 311 of 2023 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.
3. About 441 litres of illicit liquor has been recovered from the car which does not belong to the petitioners.
4. Learned counsel for the petitioners submits that the petitioners is in custody since 02.09.2023 having clean antecedent. Learned counsel further submits that the petitioners are ready to donate Rs. 25,000/- (Rupees Twenty Five
Patna High Court CR. MISC. No.74330 of 2023(2) dt.29-11-2023 2/2 Thousand Only) each in some charitable organization without accepting their guilt.
5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
6. Considering the above, this application is allowed.
7. Let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Special Excise Court No. 1, Gopalganj in connection with Phulwariya P.S. Case No. 311 of 2023.
8. This is also subject to the condition that the petitioners shall deposit an amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) each in Ramakrishna Mission Ashrama, Chapra and produce the receipt of the same before the Court below. The bail bonds of the petitioners shall be accepted after verifying the genuineness of the receipt produced by the petitioners.
