2. The petitioner seeks bail in connection with Khusrupur P.S. Case No. 313 of 2023 registered for the offence punishable under Sections 302, 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. This is the second attempt for bail of the petitioner as earlier such prayer was rejected by order dated 29.02.2024 in Cr. Misc. No. 75777 of 2023.

4. One Manmanth Kumar was killed by unknown criminals. During investigation it has come that the deceased was killed in the vehicle belonging to the petitioner. The petitioner, Aman Kumar, R.K. Singh were travelling in the

Patna High Court CR. MISC. No.74009 of 2024(4) dt.17-01-2025 2/3 vehicle and this petitioner has given a self inculpatory statement that Aman Kumar and R.K. Singh has killed the deceased and he was driving the car.

5. During investigation it has come that there is no direct evidence against the petitioner. The petitioner is in jail since 09.08.2023.

6. Learned counsel for the petitioner submits that Aman Kumar, a co-accused who is said to have killed the deceased has been granted bail by this Court vide order dated 14.03.2024 in Cr. Misc. No. 17879 of 2024.

7. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

8. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Patna/concerned Court in connection with Khusrupur P.S. Case No. 313 of 2023.

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court

Patna High Court CR. MISC. No.74009 of 2024(4) dt.17-01-2025 3/3 on each and every date fixed by the trial Court. Noncompliance of the condition will result in cancellation of the bail bonds of the petitioner.
