JUSTICE SHIVAJI PANDEY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek anticipatory bail in a case instituted for the offences under Sections 341, 323, 324, 307, 302, 504 and 34 of the Indian Penal Code.
It has been alleged in the First Information Report that one Krisna Saw and present petitioners have entered into the house of the informant and assaulted him as well as his mother and brother with different weapons, out of that incident two persons have died i.e. mother and brother and the informant is being treated in PMCH, Patna.
Learned counsel for the petitioners submits that petitioner no.2 is unmarried daughter.
Patna High Court Cr.Misc. No.37408 of 2018 (2) dt.05-07-2018 2 /2 Looking to the facts and circumstances of the case, in the event of arrest or surrender within four weeks from today, let petitioner no.2, namely, Puja Kumari, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No.199 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with a condition that when the police will call her, she will present herself for the purposes of interrogation or otherwise.
So far as petitioner no.1, namely, Anita Devi is concerned, this Court is not inclined to enlarge her on anticipatory bail. Accordingly her prayer for bail is rejected.
