2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 3(ii)(a), 14(a)(b) of the Foreigners Act.
3. The case of the prosecution is that one person was found entering in India near Maitri bridge border pillar no. 390/33 in India on a bike. On the basis of suspicion interrogation was done at the helpdesk by officials. It was found that Canadian passport from the possession of the person. It is alleged that the date of expiry of this Canadian passport is 06.05.2030 with Indian visa which was valid till 09.01.2024. Even after expiry of his visa, he was staying in India. That is why he was arrested.
4. Learned counsel for the petitioner has submitted that the only allegation against the petitioner is that he was

No.69413 of 2025(2) dt.25-09-2025 2/2 staying in India even after the expiration of visa whereas the petitioner is the original resident of India having citizenship of Canada. It has also been submitted that the petitioner is suffering from schizophrenia, a serious mental disorder requiring continuous psychiatric treatment. Learned counsel for the petitioner has further submitted that the petitioner is a man of clean antecedent and is in judicial custody since 17.05.2025.
5. Learned Additional Public Prosecutor for the State has conceded to the arguments of the learned counsel for the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Haraiya P.S. Case No. 59 of 2025 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul at East Champaran.
