The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 325, 379, 307, 385, 504, 34 of the Indian Penal Code. As per prosecution case, informant alleged that on 14.06.2022 petitioner along with co-accused persons came and demanded ransom when her husband denied to pay, they stared assaulting by means of iron rod repeatedly and they also snatched her ear-ring worth Rs. 25,000/-.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of village politics. There is general and omnibus allegation leveled
Patna High Court CR. MISC. No.68212 of 2022(2) dt.22-03-2023 2/2 against the petitioner. During investigation neither any evidence came against him nor any eye witness was present at the place of occurrence. He has got no criminal antecedent. The petitioner is languishing in judicial custody since 22.09.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody of this petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barbigha P.S. Case No. 258 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura.
