JUSTICE BIRENDRA KUMAR ORAL ORDER 20-06-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Section 414 of the Indian Penal Code, Sections 20/22 of the N.D.P.S. Act and Sections 25(1-b)a/26/35 of the Arms Act.

Submission is that co-accused Ajit Kumar was apprehended by the police and from his possession fire-arm and Ganja was recovered. Co-accused Ajit Kumar disclosed name of the co-culprit including the petitioner and co-accused Dhananjay @ Pepe. Further submission is that Dhananjay @ Pepe has already been allowed bail by the learned Special Judge, Vaishali on 06.06.2016 and petitioner is in custody since 27.03.2018.

Patna High Court Cr.Misc. No.34948 of 2018 (2) dt.20-06-2018 P2/ Nothing has been recovered from the possession of the petitioner. Investigation of the case is complete.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Hajipur Town P.S. Case No.118 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
