====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 23-10-2024 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. The petitioners are apprehending their arrest in connection with Birpur P.S. Case No. 69 of 2024 dated 21.04.2024 registered for the offences punishable under Sections 341, 323, 504, 506, 307 and 325 of the I.P.C.

3. As per the prosecution case, on 20.04.2024, the

No.73858 of 2024(2) dt.23-10-2024 2/3 petitioners are alleged to have abused and assaulted the informant and his wife, daughter and son with bricks, stones and danda, due to which, the wife and daughter of the informant got injuries in hand and on the head respectively. The son of the informant had also sustained injury. The injured were brought to the hospital for their treatment.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners were not apprehended on the spot. The petitioners are the co-villagers of the informant. There is general and omnibus allegation against them. It is further submitted that although the injuries received by the injured on vital parts of the body but are simple in nature as stated in paragraph no. 10 of the bail petition. No incriminating article has been recovered from their possession. The petitioner nos. 1 to 4 are ladies. The petitioners have clean antecedent as stated in paragraph no. 3 of the bail application.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be

No.73858 of 2024(2) dt.23-10-2024 3/3 enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M.-Ist-cum-A.M. Begusarai/concerned court in connection with Birpur P.S. Case No. 69 of 2024, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
