The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 188 and 353 of the Indian Penal Code.

The prosecution case as per F.I.R is that the petitioner being practicing advocate of Sitamarhi Civil Court had made an attempt to commit suicide by pouring kerosene oil in his body and lit himself on fire, but he was apprehended by the informant being constable with the help of other constables who were deputed in the civil court premises.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has committed no offence. The petitioner is a practicing advocate and no such occurrence has

Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner was apprehended by the police personnel while he was attempting to commit suicide by pouring kerosene oil in his body. The medical report suggests that smell of kerosene oil was present in whole body of the petitioner. Moreover, the petitioner is accused in three other cases apart from the present one.

Such kind of act of the petitioner as an advocate in the court premises as alleged in the F.I.R is unwarranted and it is not desirable for a practicing advocate to commit such an act in the court premises where he used to practice. In that view of the matter, the petitioner undertakes that he will not make any such attempt in future. Since petitioner is an advocate and he undertakes that he will not repeat such kind of suicide attempt in future, the above named petitioner is directed to be released on bail in connection with Dumra P.S. Case No. 432 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
