The petitioners are in custody in connection with Makhdumpur P.S. Case No.96 of 2015, a case under Sections 406/420 of the Indian Penal Code, Sections 4/5 of the Prize Chit and Money Circulation Scheme Act, 1978.
Seventeen persons named in the F.I.R. claims to be cheated by the self help group of which the petitioners were also members. The self help group had persuaded the aggrieved person to deposit money in the group to get better return. Submission of the learned counsel for the petitioners is that the receipt of deposit of money to all the claimants was issued by co-accused Nagendra Kumar. There is no
Patna High Court Cr.Misc. No.58204 of 2017 (4) dt.17-01-2018 P2/ document to substantiate any allegation against the petitioners, who are in custody since 18.09.2017.
Learned counsel for the State after going through the case-diary is of the view that there is no other material against the petitioners.
Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
