The petitioner seeks bail in connection with Muzaffarpur Rail P.S. Case No. 33 of 2018 registered for the offences under Sections 401 and 414 of the Indian Penal Code and Section 8/22 N.D.P.S. Act.
Allegedly, the petitioner was caught after chase and from his possession 15 Ativan tablets, wrist watch and mobile were recovered besides black color bag having old clothes. Submission is of false implication and that the petitioner has got no criminal antecedent, he is suffering in custody since 27.02.2018, chargesheet has already been
Patna High Court Cr.Misc. No.37096 of 2018(2) dt.29-06-2018 2/2 submitted and there is no chance of tampering with the prosecution evidence.
The learned APP opposes the prayer of bail.
In the facts and circumstances stated above, considering the detention of the petitioner, now he is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned District & Sessions Judge-Cum-Special Judge, Muzaffarpur in connection with Muzaffarpur Rail P.S. Case No. 33 of 2018, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the Court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
