The petitioner seeks bail in connection with Barhariya P.S. Case No. 149 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 of the Indian Penal Code.

An occurrence took place out of a very petty issue of drinking water by two members of the family of the warring parties. The minor scuffle conflagrated into violence, in which one Rama Shankar Ram is said to have attacked the husband of the informant, namely, Naresh Ram who died on the spot. Learned counsel for the petitioner submits that there petitioner has been named in the F.I.R. but no specific allegation has been levelled against him. It has been submitted on behalf of

No weapon appears to have been attributed to him, much less any assault on the body of the deceased. Petitioner is in jail custody since 31.07.2019 and he does not have any criminal antecedent. Another co-accused person, namely, Ragho Singh has been granted bail on 30.08.2019 vide Cr. Misc. No.54697 of 2019 and another co-accused Ram Ashish Ram has been granted bail on 13.09.2019 vide Cr. Misc. No.44886 of 2019. In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Barhariya P.S.
