ANJANA MISHRA ORAL ORDER 19-07-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.02.2018 in connection with Karja P.S. Case No.41 of 2018 registered for the offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act. Learned counsel for the petitioner submits that the alleged recovery was made from the common possession of those who were in the vehicle. The recovery of one pistol with live cartridge was attributed to the petitioner, which is wholly false and has been planted by the police. It is further submitted that the recovery of the loaded pistol and mobiles was attributed to the petitioner and he was made to sign on a blank paper.

No.42528 of 2018 (2) dt.19-07-2018 2/2 In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2nd (West), Muzaffarpur, in connection with Karja P.S. Case No.41 of 2018.
