The petitioner is apprehending his arrest in connection with Barharia P.S. Case No. 254 of 2015, registered for offences punishable under Sections 341, 323, 354, 504 and 34 of the Indian Penal Code.

Allegation against the petitioner is that, he entered inside the house of the complainant to outrage her modesty when she fled inside the house the petitioner, her clothes were torn and further, he has assaulted by lathi and danda and taken away her. Submission of the learned counsel for the petitioner is that there is land dispute between the parties and as petitioner is the brother of the husband of the informant and for that, he has falsely been implicated in the present case.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateVI, Siwan, in connection with Barharia P.S. Case No. 254 of 2015, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
