The petitioner has filed the instant application for grant of regular bail in connection with Pupri P.S. Case No. 318 of 2022 registered under Sections 304(B) and 34 of the Indian Penal Code.
It is a case of dowry death of the informant's sister due to non-fulfillment of dowry demand.
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is mother-in-law of the deceased due to which she has falsely been implicated in this present case. It is further submitted that She has no concern with the mess and business of the deceased as well as her husband. Petitioner was living separately from the
Patna High Court CR. MISC. No.67545 of 2022(2) dt.18-01-2023 2/2 deceased as well as from her husband. The husband of the deceased is in judicial custody. There is general and omnibus allegation and no specific overt-act against the petitioner. She is languishing in judicial custody since 06.09.2022. The application for bail is vehemently opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Pupri P.S. Case No. 318 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi.
