Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Pataghat PS case no. 62 of 2024, disclosing offences punishable under Sections 413, 414/34 of the Indian Penal Code.

As per the First Information Report, the allegation against the petitioner is that he along with other co-accused persons parked the motorcycle near the hut of informant, which was later on found to be stolen one.

Learned Counsel for the petitioner submits that petitioner has falsely been implicated in this case at the behest of informant, due to village politics as the petitioner and informant are residents of the same village. Learned counsel
Patna High Court CR. MISC. No.75432 of 2024(3) dt.18-11-2024 2/2 further submits that for theft of the motorcycle, Madhepura (Ghailarh O.P.) PS Case No. 215 of 2024 has been lodged by one Nand Kishor Yadav against unknown. The petitioner is stated to be having clean antecedent.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that petitioner is having no criminal antecedent, I am inclined to grant the privilege of anticipatory bail to the petitioner. 6.
This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Pataghat PS case no. 62 of 2024, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
