The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 25(1-b)a/26 of the Arms Act.
The prosecution case, in brief, is that the petitioner has been arrested in connection with Phulwarisharif P.S. Case No. 344 of 2022 wherein, he accepted his involvement in this case and at his instance, police recovered a country made pistol containing one bullet from Tamtamp Parav graveyard. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner has no concern with the alleged recovery of arms which was seized by
Patna High Court CR. MISC. No.70142 of 2022(2) dt.14-03-2023 2/2 the police rather his name was dragged into this case from another case of Phulwarisharif P.S. Case No. 344 of 2022. Nothing incriminating article has been recovered from conscious possession of the petitioner. It is further submitted that the petitioner is languishing in judicial custody since 15.5.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Phulwarisharif P.S. Case No. 516 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIV at Patna.
