The petitioner seeks bail in a case instituted for the offences under Sections 302, 201/34 of the Indian Penal Code. The earlier bail application of the petitioner was rejected vide Annexure-1 with a direction to the Court below to conclude the trial preferably within a period of one year from the date of receipt/production of copy of the order but till date only charge has been framed and no witness has been examined. Petitioner is in custody since 22.01.2016. He has remained in custody for more than two years. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. There is no eye witness to the alleged occurrence nor any specific allegation of

Patna High Court Cr.Misc. No.59274 of 2017(3) dt.21-03-2018 2/2 assault has been levelled against this petitioner nor there is any substantive evidence to suggest his implication in the present case. The alleged occurrence is said to have taken place after 25 years of marriage.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R and he is the husband of the deceased.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali in connection with Bidupur P.S. Case No. 1/2014.
