2. The petitioner apprehends his arrest in connection with Kinjar P.S. Case No. 112 of 2023 registered for the offence under Sections 406, 409, 420 of the Indian Penal Code.

3. As per the prosecution case, the petitioner, who is Branch Manager of Union Bank, is alleged to have defalcated Rs. 4 lakhs from the informant.

4. It has been submitted by the learned counsel for

Patna High Court CR. MISC. No.69372 of 2025(5) dt.09-03-2026 2/3 the petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that the petitioner is ready to return the alleged defalcated amount to the informant without accepting his guilt.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, in the event of his arrest or surrender before the concerned Court below within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal/concerned Court below in connection with Kinjar P.S. Case No. 112 of 2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482 of the BNSS.

7. As a condition of this order, the petitioner, at the time of furnishing his bail bonds, will produce a demand draft of Rs. 4,00,000/- and then only his bail bonds shall be accepted. It is made clear that the demand draft shall be kept in fixed deposit by the Court below and the same shall be released in favour of the petitioner or the bank, subject to the outcome of the trial i.e. if the petitioner is acquitted then the maturity amount of the
