JUSTICE BIRENDRA KUMAR ORAL ORDER 12-12-2017 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

According to FIR, co-accused Manish Kumar and others including the petitioners are alleged to have kidnapped the minor daughter of the informant. The victim girl in her statement under Section 164 Cr.P.C. stated that in fact co-accused Manish Kumar and his cousin brother Rajesh had abducted her and they took her through a train to Delhi. The petitioners were also present at that time, who are brothers of co-accused Manish Kumar.

Patna High Court Cr.Misc. No.58126 of 2017 (2) dt.12-12-2017 Manish Kumar was pressurizing to marry with her. Submission of the petitioners is that this matter relates to love affairs and the petitioners have falsely been implicated in this case.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ben Police Station Case No.83 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
