====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 04-01-2023 Heard Mr. Bimal Kumar, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned A.P.P. for the State.

In compliance of order dated 07.12.2022, the Additional District and Sessions Judge-III, Katihar has submitted his report contained in letter no. 218 of 2022 dated 21.12.2022 informing this Court that only non-official witnesses are yet to be examined but inspite of the summon rest witnesses have not appeared.

In such circumstances, the Superintendent of Police, Katihar is directed to produce all the non-official witnesses without fail on each and every date fixed by the trial court, in case he fails to perform his duty, leading to the failure of justice

Patna High Court CR. MISC. No.67900 of 2022(3) dt.04-01-2023 2/2 then he shall have to file his personal show-cause as to why because of his inaction trial has been halted. The trial court is directed to take steps to conclude the trial expeditiously preferably well within a period of five months.
