2. The petitioner is in custody since 16.07.2023 in connection with Harnaut P.S. Case No. 389 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 10 litres of illicit liquor has been recovered from plastic bag.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submits that nothing incriminating has been recovered from the possession of the petitioner. He next submits that no cogent material has come in the case diary to connect the petitioner with the alleged crime.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.72705 of 2023(2) dt.09-11-2023 2/2 behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Nalanda at Biharsharif, in connection with Harnaut P.S. Case No. 389 of 2023.

7. The petitioner is directed to mark his attendance in Bakhtiyarpur police station on every Sunday.

8. It is made clear that any default in appearance in the aforesaid police station, as directed, would result in cancellation of bail bond of the petitioner.
