Petitioner seeks bail in a case registered for the offences punishable under Section 395 of the Indian Penal Code. The F.I.R. of the occurrence of Dacoity is against unknown. The name of the petitioner surfaced in the confessional statement of the co-accused.

Submission is that no incriminating article was recovered from the possession of the petitioner, nor he was ever put on T.I. Parade. The petitioner has got no criminal antecedent. The investigation of the case is complete. The petitioner is in custody since 15.02.2018.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.35708 of 2018 (2) dt.27-06-2018 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baruraj Police Station Case No.180 of 2017, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
