2. The petitioner is apprehending his arrest in connection with Kaluahi P.S. Case No. 149 of 2023 dated 18.07.2023, registered for the offence punishable under Sections 272, 273, 414 and 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act pending in the Court of learned Additional Session Judge-II cum Special Judge, Excise Act, Madhubani.

3. After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed as withdrawn.

6. However, if the petitioner surrenders before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the

Patna High Court CR. MISC. No.70732 of 2023(2) dt.01-12-2023 2/2 order, preferably, on the same day, without being prejudiced by this order.
