2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 309 (4) of the BNS and corresponding to Section 392 of the Indian Penal Code.
3. The case of the prosecution is that the informant was going on his bike after collecting a cash and when he reached near Galgal Chowk, three miscreants came on motorcycle and snatched Rs. 28,950/-, Bike, Mantra Device and two LED Bulb from the informant on the point of pistol.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the

During the course of investigation, one Ravikant Kumar @ Ravi confessed his guilt and on the basis of his confessional statement, name of the petitioner has surfaced. It is further submitted that nothing incriminating has been recovered from conscious possession of the petitioner. It is further pointed out by the learned counsel for the petitioner that from perusal of the order of the trial Court, it will transpire that a Honda Shine SP motorcycle registered in the name of this petitioner was shown to have been used in the commission of crime. However, a plain reading of the FIR, it is clear that Apache Bike was used in the commission of crime. Moreover, the petitioner is languishing in judicial custody since 24.02.2025.
5. Learned APP appearing for the state has opposed the prayer of regular bail stating that the petitioner has four criminal antecedents.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khanpur P.S. Case No. 160 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned
Patna High Court CR. MISC. No.67341 of 2025(2) dt.17-09-2025 3/3 Judicial Magistrate, 1st Class, Samastipur with a condition that the petitioner shall cooperate in the trial and shall appear in person as and when required.
