The petitioner is in judicial custody in connection with Bettiah Town P.S. Case No. 705 of 2021 for the offences under sections 376/120B of the Indian Penal Code and Section 8 of the POCSO Act.
The prosecution story in brief is that on 17.12.2021, at 6:30 P.M., the informant gave her 'fardbeyan' before the Bettiah police station that her 12 years minor daughter went to school but did not return till 12:00 P.M. in the noon. It is further alleged that at about 3:30 P.M., when her daughter came home, the victim disclosed that she had gone to Bettiah with the accused Bebi Begum where the other accused Ejajul Mian had committed rape. Thereafter, both the accused persons left the
Patna High Court CR. MISC. No.1478 of 2023(2) dt.11-01-2023 2/2 victim girl at 'Tikuliya Chowk'. It was alleged that accused Azazul Mian had committed rape with the victim girl in conspiracy with accused Bebi Begum.
The present petition has been filed without bringing on record anything new.
Earlier, the bail application vide Cr. Misc. No. 18652 of 2022 on 27.7.2022 was dismissed on merit taking into account the allegation that the petitioner has raped a minor girl. The bail application once again stands dismissed. The trial court is directed to take steps and conclude the trial expeditiously, preferably within a period of one year. (Rajiv Roy, J) Ravi/- U T
