ANJANA MISHRA ORAL ORDER 16-07-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners have been in custody since 25.04.2018 in connection with Dighwara P.S. Case No. 216 of 2017 registered for the offences punishable under Sections 366 with 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the person who is alleged to have taken away the wife of the informant was actually Bhola Paswan as the victim lady in her statement under Section 164 Cr. P.C. has categorically stated that Bhola Paswan kidnapped her and had taken her to several places. It is further submitted that actually she was having an affair with the said Bhola Paswan and now the entire occurrence has been
Patna High Court Cr.Misc. No.36588 of 2018 (2) dt.16-07-2018 compromised. It is further submitted that the petitioner No. 1 Krishna Paswan and petitioner No. 2 Bholi Paswan are the own brothers of Bhola Paswan who has since been extended the benefit of anticipatory bail in Cr. Misc. No. 34644 of 2018 vide order dated 02.07.2018.
In view of the aforementioned facts and circumstances and that these petitioners have a clean antecedent, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra, in connection with Dighwara P.S. Case No. 216 of 2017.
