JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-10-2018 Learned counsel for the petitioner submits that because no confiscation proceeding is pending presently the submission of sureties be directed in the court of learned Chief Judicial Magistrate, Purnea.
In the aforesaid view of the matter, let the operative part of the order dated 03.10.2018 be read as direction to the petitioner to submit two sureties for the value of the vehicle in question as indicated in the insurance document to the satisfaction of the learned Chief Judicial Magistrate, Purnea. The other conditions prescribed in the said order to submit an undertaking before the District Magistrate, Purnea shall also be read that such requirement is required to be submitted before the learned Chief Judicial Magistrate, Purnea.
Patna High Court Cr.Misc. No.59334 of 2017 (4) dt.29-10-2018 On furnishing the sureties and undertaking as stated above in the order dated 03.10.2018, the learned Chief Judicial Magistrate, Purnea shall issue the release order. (Rajeev Ranjan Prasad, J) Arvind/- U T
