Petitioner, already in custody, seeks bail in connection with Khodawandpur PS Case No.92 of 2017 registered under Sections 341, 323, 307, 379, 504 and 34 of the Indian Penal Code.
Allegation in brief is that levelling charge of witch craft, America Yadav gave farsa blow over the head of the informant causing head injury thereafter the petitioner and others assaulted her with iron rod and lathi. Learned counsel for the petitioner submits that there is no specific allegation against the petitioner that where he assaulted the informant; whereas the specific allegation is
Patna High Court Cr.Misc. No.35630 of 2018(2) dt.21-06-2018 2/2 against America Yadav who gave first blow over the head causing injury on that portion of the body, except the sole injury, there is no other injury on the person of the informant, the petitioner is in custody for approximately three months and bears no criminal antecedent.
Having considered the aforesaid facts and circumstances, petitioner Munna Yadav @ Muni Lal Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM (Manjhaul), Begusarai in connection with Khodawandpur PS Case No.92 of 2017.
