JUSTICE BIRENDRA KUMAR ORAL ORDER 15-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with N.C.B. Case No.10 of 2017, a case under Section 8/20 of the N.D.P.S. Act, pending in the Court of learned Sessions Judgecum-Special Judge, Muzaffarpur. 810 Kgs. of Ganja was recovered from the truck of which the petitioner was alleged to be a cleaner. Submission of the learned counsel for the petitioner is that the petitioner is in custody since 15.06.2017. He has got no criminal antecedent and the driver of the truck Balbir Singh has

Patna High Court Cr.Misc. No.60222 of 2017 (4) dt.15-02-2018 P2/ confessed before the police wherein he has specifically stated that the petitioner had no knowledge of the recovered Ganja because he had reached Guwahati through train.

However, the driver has not disclosed the name of any other cleaner of the truck.

Learned counsel for the Union of India opposed the prayer for bail.

Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial.
