The petitioner in the present case is seeking regular bail in connection with Govindganj (Areraj) P.S. Case No.163 of 2019 registered for the offence punishable under Sections 341, 323, 354(A), 376, 452 and 506 of the Indian Penal Code and Section 4/6 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. Learned counsel submits that the petitioner has committed no offence as alleged in the FIR. Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.62447 of 2019(3) dt.03-12-2019 2/2 wherein there is a direct allegation of committing rape is against the petitioner and the petitioner has remained in custody only since 14.06.2019, this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed. Let the trial be expedited.
