The petitioner apprehends his arrest in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 349 of 2019, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that on receiving information about firing in between two groups of Nanda Mandal (petitioner) and Balo Yadav to capture the Gairmajarua land in village Dodhi, the informant, Dayashankar Yadav, along with other police personal reached there then saw that both groups were indulging in making firing. Nanda Mandal (petitioner), Subba Yadav, Sanjay Mandal, Manoj Mandal, Bikash Mandal, Shayam Mandal, Sindhu Yadav and Anuj Yadav were members in one group whereas Balo Yadav, Shiv Yadav, Basuki Yadav, Ranjeet Yadav, Hardeo Yadad and some

On reaching there, informant and other police personnel made attempt to stop the firing but on creating fear, both groups started to flee away. On spot, three alive cartridges and some empty cartridges were recovered. Mr. Rajiv Ranjan Singh, learned counsel for the petitioner submitted at bar that while petitioner is accused in two other cases, i.e., Nath Nagar (Madhusudanpur) P.S. Case No. 379 of 2018 and Nath Nagar (Madhusudanpur) P.S. Case No. 323 of 2018, but in both cases, petitioner is on bail.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Bhagalpur, in connection with Nath Nagar (Madhusudanpur) P.S. Case No. 349 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
