Petitioner, already in custody, seeks bail in connection with Chandan (Anandpur) PS Case No.03 of 2017 registered under Sections 121, 121(A), 120(B) of the Indian Penal Code, under Sections 25(1-b)a/26 of the Arms Act as well as under Sections 9, 10, 11 and 13 of the U.A.P. Act.

The police raided the forest area getting information regarding assembly of members of extremist outfit and apprehended one person Ramayan Turi and from his possession arms were recovered as well as some naxalite literature and he revealed names of other associates including the petitioner. Learned counsel for the petitioner submits that except disclosure of name of the petitioner by apprehended accused,

No.35672 of 2018(2) dt.21-06-2018 2/2 there is no other material against him and, the petitioner has no criminal antecedent or any association with extremist outfit and the petitioner is in custody for more than six months. Having considered the aforesaid facts and circumstances, petitioner Manoj Khaira is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Banka in connection with Chandan (Anandpur) PS Case No.03 of 2017.
