1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 316(5), 318(4), 338 and 3(5) of the BNS.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that accused persons including the petitioner have withdrawn money from the Pradhan Mantri Awas Yojna by scanning the account number of genuine beneficiaries and also tampered with the records.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that the petitioner has not withdrawn any money rather the same was credited in his

Patna High Court CR. MISC. No.68511 of 2025(2) dt.08-10-2025 2/2 account on account of mistake committed by the Awas Sahayak and when they were informed by the Awas Sahayak about the mistake, the money was credited in the account of the State Nodal Bank as would manifest from Annexure-2 series to the anticipatory bail application.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Baheri P.S. Case No. 207 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
