28-06-2018 Heard Sri Manohar Prasad, learned counsel assisted by Sri Samir Kumar Sinha, learned counsel for the petitioner and Sri Nagendra Prasad, Addl. Public Prosecutor. The sole petitioner, having clean antecedent,which fact has been stated in paragraph - 3 of the petition,apprehending his arrest in Nalanda P.S. Case No. 58 of 2018 registered for offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender.

Learned counsel for the petitioner has drawn my attention to seizure list i.e. enclosure to the F.I.R. at page 14 that 6 liters of country-made liquor was found near the poultry farm of the petitioner and petitioner has been made accused, as if, he

Considering the nature of accusation, clean antecedent as well as the fact that nothing was recovered either from his conscious possession or from his premises, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Pashuram @ Parshuram Yadav @ Pashuram Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Addl. District and Sessions Judge cum Special Judge, Excise, Nalanda, Bihar Sharif in connection with Nalanda P.S. Case No. 58 of 2018, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
