The petitioner seeks pre-arrest bail in connection with Madanpur P.S. Case No. 113 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 307, 506 and 504 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioner that no allegation of any overt act has been alleged against the petitioner in the first information report. He submitted that from perusal of the first information report itself, it would manifest that the petitioner was not even present on the
Patna High Court Cr.Misc. No.58455 of 2017 (2) dt.12-12-2017 place of the alleged occurrence when the occurrence took place. He submitted that during the whole investigation no material implicating the petitioner has come except the rumour about the catching hold of the hand of Chandani Kumari. Learned counsel for the State does not dispute the contentions made by the learned counsel for the petitioner. Considering the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 113 of 2017 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
