Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 365 and 366(A) of the Indian Penal Code.
Though allegation in the F.I.R. is that the petitioner kidnapped to the daughter of the informant, the victim in her statement under Section 164 Cr.P.C. stated that she had voluntarily gone with the petitioner. The victim is a major for her statement, which is at Annexure-3.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.35681 of 2018 (2) dt.27-06-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Bochahan Police Station Case No.22 of 2018, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
