JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149,n 341, 323, 307, 427, 504, 506 of the Indian Penal Code and 25(1-b)a 26,27 of the Arms Act.

Petitioner is said to have opened fire on account of land dispute and according to the prosecution case itself, petitioner was caught on the spot but nothing was recovered from his conscious possession. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above

No.67047 of 2019(2) dt.04-11-2019 2/2 named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial MagistrateV Kaimur at Bhabhua in connection with Bhagwanpur P.S. Case No. 146 of 2019.
