The petitioner seeks bail in connection with Bhagalpur Rail P.S. Case No. 113 of 2023 instituted for the offence under Sections 467, 468, 471, 385, 170 & 171 of the Indian Penal Code.

The prosecution case, in short, is that the petitioner allegedly posed as a constable of the Bihar Police and carried forged ID card, badge and collected money, while issuing threats in the name of police.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.05.2023. Petitioner bears no criminal antecedent, as per disclosure made in
Patna High Court CR. MISC. No.67905 of 2025(4) dt.19-11-2025 2/3 paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Informant is not the eye witness of the case. There is no material against the petitioner to establish the fact that he had collected money from the public. Nothing has been recovered from the conscious possession of the petitioner. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.
A report was called for from the court below and it is reported that altogether four prosecution witnesses have been examined and statement of accused was recorded under Section 313 of the Cr.P.C. It is further reported that the case is fixed for defence witness.

Considering the aforesaid facts and circumstances of the case and specifically taking into account the fact that trial is on the verge of its conclusion, this Court is not inclined to grant bail to the petitioner. Hence, prayer for bail is hereby rejected.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and
