====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 22-06-2018 Heard learned counsels for the petitioner and the State.

The petitioner, already in custody, seeks bail in connection with Sadar (Saharsha) P.S. Case No. 448 of 2018, registered under Sections 379/34 of the Indian Penal Code. Allegation in brief is that in CCTV footage it was captured that the petitioner is a tempo driver handed over some article to steal the motorcycle of informant. Later on stolen the motorcycle and fled away over the motorcycle. Learned counsel for the petitioner submits that petitioner is a tempo driver and the allegation of committing theft alongwith some other unknown persons is false and fabricated. He had parked his tempo near nursing home and this petitioner has no any antecedent of theft.

No.36017 of 2018(2) dt.22-06-2018 2/2 Having considered the aforesaid facts and circumstances, the petitioner, namely Mangal Yadav is directed to be released on bail subject to confirmation of his criminal antecedent upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsha, in connection with Sadar (Saharsha) P.S. Case No. 448 of 2018.
