Petitioner apprehends arrest in connection with Sitamarhi Mahila P.S. Case No. 13 of 2018 registered for the offence punishable under sections 341, 323, 498A, 504/34 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in the present case. As a matter of fact, the present informant had earlier also lodged a case against this petitioner. Moreover,
Patna High Court CR. MISC. No.62702 of 2019(2) dt.17-10-2019 2/2 petitioner has filed Matrimonial Case No. 42 of 2018 for restitution of conjugal rights which has been decided by the learned Principal Judge, Family Court, Sitamarhi in favour of the petitioner vide judgment contained in Annexure-2. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sadar, Sitamarhi in connection with Sitamarhi Mahila P.S. Case No. 13 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
