Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

9.600 litres of foreign liquor is said to have been recovered from the possession of the accused Ravi Paswan while petitioner managed to escape and said Ravi Paswan disclosed the name of the petitioner as his fleeing accomplice. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern

Patna High Court Cr.Misc. No.41403 of 2018 (2) dt.11-07-2018 2/2 with the seized liquor. He has been falsely implicated in the case by the said Ravi Paswan due to animosity. Barring the aforesaid disclosure, there is nothing in the record indicating the complicity of the petitioner in the occurrence. Though two more criminal cases have been lodged against the petitioner, but he is on bail in the aforesaid cases. He has been languishing in custody since 22.03.2018.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Court, Excise, Rohtas at Sasaram in connection with Excise Case No. 15 of 2018.
